By creating an account on or otherwise accessing Spark to Story (“the Service”), operated by Derek Tran (“we,” “us,” “our”), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
You must be at least 13 years old (or 16 if you reside in the European Economic Area) to use the Service. By using the Service you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
Spark to Story is an AI-powered novel writing command center that provides tools for planning, writing, editing, and publishing fiction. The Service includes a web-based dashboard, AI-assisted writing and editing tools, and integrations with third-party publishing platforms such as Royal Road.
The Service is currently in limited-access beta and available by invitation only. Beta features may be incomplete, contain bugs, or be modified or discontinued without notice. We reserve the right to approve or deny access at our sole discretion.
Access to the Service requires authentication via Google OAuth. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us promptly of any unauthorized use.
You retain full ownership of all content you create, upload, or store using the Service, including story plans, character profiles, chapter drafts, worldbuilding documents, and published works (“Your Content”). We claim no intellectual property rights over Your Content.
You grant us a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content solely as necessary to operate and provide the Service to you. This license terminates when you delete Your Content or close your account.
You represent that you have the right to upload or create all content you submit to the Service and that Your Content does not infringe any third party’s intellectual property or other rights.
AI disclosure.The Service uses third-party artificial intelligence models provided by Anthropic (Claude) to assist with content planning, generation, and editing. When you use AI-assisted features, portions of Your Content are sent to Anthropic’s API for processing.
No training on your work.We do not use Your Content to train, fine-tune, or improve any AI or machine learning model. Anthropic’s commercial API terms likewise prohibit training on API inputs and outputs.
Your responsibility. You are solely responsible for reviewing, editing, and publishing any AI-assisted content. We do not guarantee the accuracy, originality, quality, or legal suitability of AI-generated suggestions or output.
No copyright warranty. The legal status of copyright protection for AI-assisted works is evolving and varies by jurisdiction. We make no representation that AI-generated or AI-assisted content qualifies for copyright protection. You assume all risk related to intellectual property rights in AI-assisted output.
Non-exclusivity. AI models may generate similar or identical content for different users from similar prompts. We do not guarantee that AI output provided to you will be unique.
Model changes. We may update or change the underlying AI models at any time. We will make reasonable efforts to notify users of changes that materially affect output quality or behavior.

You must also comply with Anthropic’s Acceptable Use Policy when using AI-assisted features. Violations of this section may result in immediate account suspension or termination.
The Service integrates with third-party platforms including Google (authentication), Supabase (data infrastructure), Anthropic (AI), and Royal Road (publishing). Your use of these integrations is subject to the respective third-party terms. We are not responsible for the availability, content policies, or practices of third-party services.
When you publish content to Royal Road or other platforms through the Service, you are the publisher. We act solely as a tool facilitating the upload at your direction and assume no editorial responsibility for published content.
We respect intellectual property rights and respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”).
If you believe content on the Service infringes your copyright, send a written notice to our designated agent at dmca@sparktostory.ai containing:
We may remove or disable access to allegedly infringing content and will terminate the accounts of repeat infringers in appropriate circumstances.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT GENERATED BY AI WILL BE ACCURATE, ORIGINAL, OR FREE FROM INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR CREATIVE WORKS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Derek Tran and any affiliates, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
Governing law. These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
Informal resolution. Before filing any formal proceeding, you agree to first contact us at hello@sparktostory.ai and attempt to resolve the dispute informally for at least 30 days.
Arbitration.Any dispute not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in the county of your residence or remotely by videoconference, at your election. The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction.
Opt-out. You may opt out of this arbitration clause by sending written notice to hello@sparktostory.ai within 30 days of first accepting these Terms. If you opt out, disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
Class action waiver. All disputes must be brought in an individual capacity. You waive any right to participate in a class action, class arbitration, or representative proceeding.
Exceptions. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights. Claims eligible for small claims court may be filed there.
You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate your access at any time, with or without cause, with or without notice, including for violation of these Terms.
Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export Your Content before deletion. Sections 5 (ownership), 6 (AI disclaimers), 10-13 (disclaimers, liability, indemnification, disputes), and 17 (general) survive termination.
We may update these Terms from time to time. For material changes, we will notify you by email or prominent notice within the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you provide suggestions, ideas, or other feedback about the Service (“Feedback”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, modify, and incorporate that Feedback for any purpose without obligation to you.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure failures, or third-party service outages (including AI provider outages).
Electronic communications. You consent to receive communications from us electronically (email or notices within the Service). Such communications satisfy any legal requirement that communications be in writing.
